By using the Whicha application (the “Service”) you agree to these Terms. If you do not agree, do not use the Service. We may update these Terms; continued use constitutes acceptance.
1. Use of Service
You are responsible for your account and all content you submit. Do not attempt to circumvent security, scrape at scale, or disrupt normal operation.
2. Content
You retain rights to your content but grant us a license to host, display, and transmit it for operation of the platform. We may remove content that violates these Terms.
3. Prohibited Content & Conduct
Any question or poll that encourages, depicts, glorifies, incites, or could result in harm to yourself or any other living being is strictly prohibited. This includes but is not limited to self-harm prompts, threats, targeted harassment, hate, exploitation, or violence. Do not share private personal data (yours or others) or engage in spam, impersonation, or fraud.
3a. Child Safety Standards (CSAE Prohibition)
These Child Safety Standards apply to Whicha (the “Service”), published by The Flaggship Group LLC. We have zero tolerance for child sexual abuse and exploitation (CSAE), including child sexual abuse material (CSAM).
Content and behavior are strictly prohibited if they involve, depict, encourage, promote, facilitate, or seek CSAE/CSAM in any form. This includes (without limitation) sexual content involving minors, grooming, sexual solicitation of minors, sexualization of minors, trafficking or exploitation, and any attempt to share, request, or direct others to CSAM.
We may remove violating content, restrict features, suspend or permanently ban accounts, and preserve evidence as needed. Where appropriate and legally required, we may report to relevant authorities.
Reporting: If you see content or behavior that may involve CSAE/CSAM, report it in-app (where available) and/or email us at support@whicha.app. If someone is in immediate danger, contact local emergency services.
4. Safety & Enforcement
We may remove violating polls, restrict features, or suspend accounts. Severe or repeated violations may lead to termination. We may cooperate with authorities when legally required.
5. Disclaimers
The Service is provided “as is” without warranties of any kind. We do not guarantee uninterrupted availability or accuracy of content.
6. Limitation of Liability
To the maximum extent permitted by law, our aggregate liability for claims arising out of use of the Service shall not exceed the amount you paid us (if any) in the preceding 12 months.
7. Termination
You may stop using the Service at any time. We may suspend or terminate access for violations or risk to the platform or users.
8. Changes
Material changes will be reflected by updating the date above. Continued use after changes means you accept the revised Terms.
